Please read these terms carefully before placing an order with us. These terms explain who we are, how a contract is formed, payment and delivery arrangements, your rights to cancel an order, returns and refunds, and our responsibilities to you.
Nothing in these terms affects your statutory rights as a consumer.
- About these terms
1.1 These Terms and Conditions of Sale apply to purchases of products made by consumers through our website.
1.2 By placing an order through our website, you confirm that you have read and agree to these terms.
1.3 You should read these terms together with any product information, delivery information, returns information and other information displayed on our website before placing your order.
1.4 If you are purchasing products wholly or mainly for purposes relating to your trade, business, craft or profession, these consumer terms may not apply to your purchase. Please contact us before ordering if you are purchasing on behalf of a business.
- Product information
2.1 We take reasonable care to ensure that product descriptions, images, specifications and prices displayed on our website are accurate and up to date.
2.2 Product images are for illustrative purposes only. While we try to display colours and appearances accurately, the actual appearance of a product may vary depending on your device or screen.
2.3 Where a product includes software, downloadable content, digital content, accessories or other items, these will be identified in the relevant product description.
2.4 You should check the product description and specifications before placing your order and contact us if you require clarification about a product.
- Prices
3.1 The price of each product will be the price displayed on our website at the time you place your order.
3.2 Unless otherwise stated, prices include VAT where VAT is applicable.
3.3 Delivery charges will be displayed separately before you complete your order.
3.4 We take reasonable care to ensure that prices displayed on our website are correct. If we discover a genuine pricing error after you have placed an order, we will contact you as soon as reasonably possible.
3.5 If the correct price of a product is higher than the price displayed on our website, we may contact you before dispatch to ask whether you wish to proceed at the correct price. If you do not wish to proceed, we will cancel the order and refund any payment you have made.
- Placing an order
4.1 You can place an order by following the ordering process on our website.
4.2 Before submitting your order, you will have an opportunity to review your order and correct any errors.
4.3 When you submit an order, you are making an offer to purchase the products in your order.
4.4 We will send you an acknowledgement email confirming that we have received your order. This acknowledgement does not necessarily mean that your order has been accepted.
4.5 A contract between you and us for the purchase of the products will be formed when we send you an email confirming that we have accepted your order, or when we dispatch the products to you, whichever occurs first.
4.6 We may be unable to accept an order in certain circumstances, including where:
- a product is unavailable;
- there is an error in the product description or price;
- we reasonably suspect fraudulent or unauthorised activity;
- we are unable to obtain payment; or
- we are unable to deliver to the address provided.
4.7 If we cannot accept your order after you have paid, we will contact you and refund any payment taken for the affected order.
- Payment
5.1 Payment must be made using one of the payment methods made available to you at checkout.
5.2 Payment must be received before we are required to dispatch your order, unless we have expressly agreed otherwise with you.
5.3 We do not store full payment card details on our own systems where payment is processed by a third-party payment provider.
5.4 If your payment is declined or reversed, we may be unable to process or dispatch your order until valid payment has been received.
- Delivery
6.1 We will deliver your order to the delivery address provided during checkout.
6.2 The estimated delivery times and available delivery options will be displayed during the ordering process.
6.3 Delivery times are estimates unless we have expressly agreed a specific delivery date with you.
6.4 Unless otherwise agreed with you, we will deliver your order without undue delay and, in any event, within 30 days of the day on which the contract is formed.
6.5 If a specific delivery date is essential to you, please contact us before placing your order to confirm whether we can meet that date.
6.6 If your order is delayed through no fault of your own, you may have legal rights to cancel the contract and receive a refund in circumstances provided for by law.
6.7 Risk in the products will pass to you when you, or a person nominated by you (other than the carrier), takes physical possession of the products.
6.8 If you have asked us to leave your order in a particular location or with a particular person, you acknowledge that delivery may be treated as completed once the order has been delivered in accordance with those instructions, subject to your statutory rights.
- Our responsibility for the products
7.1 We are legally required to supply products that are:
- of satisfactory quality;
- fit for any particular purpose you have made known to us;
- as described; and
- otherwise in accordance with your statutory rights.
7.2 Nothing in these terms excludes or limits your statutory rights.
7.3 If a product is faulty, damaged, not as described or otherwise does not comply with your statutory rights, please contact us as soon as reasonably possible.
7.4 Depending on the circumstances and your legal rights, you may be entitled to a repair, replacement, price reduction or refund.
7.5 Your statutory rights are not affected by any manufacturer’s warranty or guarantee. A manufacturer’s warranty is additional to your legal rights and does not replace them.
- Your right to cancel an online order
8.1 If you are a consumer purchasing products online, you generally have a legal right to change your mind and cancel your contract within 14 days without giving a reason.
8.2 For an order consisting of a single product, the cancellation period generally ends 14 days after the day on which you, or a person nominated by you (other than the carrier), receives the product.
8.3 Where your order contains multiple products that are delivered separately, the cancellation period generally ends 14 days after the day on which you receive the last product.
8.4 To exercise your right to cancel, you must clearly tell us that you have decided to cancel your contract. You may do this by email, post or by using our online cancellation process if one is provided.
8.5 You must send your cancellation communication before the cancellation period expires.
- Exceptions to the right to cancel
9.1 Certain products and contracts are excluded from the statutory right to cancel.
9.2 Depending on the circumstances, these can include:
- products made to your specifications or clearly personalised;
- sealed products which are not suitable for return for health protection or hygiene reasons where the seal has been broken;
- sealed audio or video recordings or computer software where the seal has been broken;
- digital content that is not supplied on a tangible medium, where you have expressly agreed that we may begin supplying the digital content before the end of the cancellation period and acknowledged that you would lose your right to cancel;
- products which are liable to deteriorate or expire rapidly; and
- other products or services falling within statutory exceptions.
9.3 Where an exception applies, we will provide the relevant information before you place your order where required by law.
- Returning products after cancellation
10.1 If you cancel your contract under your statutory cancellation rights, you must return the products to us without undue delay and, in any event, within 14 days after the day on which you tell us that you wish to cancel.
10.2 You are responsible for the direct cost of returning products and ensuring delivery to the advised return address which you may need to prove delivery unless:
- we have agreed to pay the return costs;
- the product is faulty, damaged or not as described; or
- applicable law requires us to pay those costs.
10.3 You are responsible for taking reasonable care of products while they are in your possession.
10.4 You may handle products to the extent necessary to establish their nature, characteristics and functionality, in the same way that you would reasonably be permitted to do in a shop.
10.5 If you handle a product beyond what is reasonably necessary to establish its nature, characteristics and functionality, you may be responsible for any resulting reduction in the value of the product, to the extent permitted by law.
- Refunds
11.1 If you cancel a contract under your statutory cancellation rights, we will refund the payments we have received from you, including the cost of standard delivery where applicable.
11.2 If you selected a more expensive delivery option than the least expensive standard delivery option we offer, we are only required to refund the cost of the least expensive standard delivery option.
11.3 We will normally make refunds using the same payment method you used to make the original purchase, unless we have agreed otherwise with you.
11.4 We may withhold reimbursement until we have received the products back or you have provided evidence that you have sent them back, whichever is earlier.
11.5 Where the law allows us to do so, we may make a deduction from your refund to reflect any loss in value caused by handling the products beyond what is reasonably necessary to establish their nature, characteristics and functionality.
- Faulty, damaged or incorrect products
12.1 If your product arrives damaged, is faulty, is not as described or you have received the wrong product, please contact us at info@impgaming.co.uk as soon as reasonably possible.
12.2 We may ask you for photographs or other reasonable information to help us understand the issue. This does not affect your statutory rights.
12.3 Where a product is faulty or otherwise does not comply with your statutory rights, we will provide the remedy required by law.
12.4 You should not return a faulty product at your own expense where applicable law requires us to meet the reasonable return costs.
12.5 Nothing in this section limits any rights you may have under the Consumer Rights Act 2015 or other applicable consumer legislation.
- Warranties and manufacturer’s guarantees
13.1 Some products may be supplied with a manufacturer’s warranty or guarantee. iMP tech products are typically guaranteed for 1 Year from date of purchase by you.
13.2 Where a manufacturer’s warranty or guarantee applies, details will normally be provided with the product or in the relevant product documentation.
13.3 A manufacturer’s warranty or guarantee is separate from your statutory rights against us.
13.4 We will not remove or reduce your statutory rights by referring you to a manufacturer’s warranty.
- Digital products and software
14.1 Where we sell digital content, including downloadable games, software, codes or other digital products, additional terms may apply.
14.2 Where digital content is supplied immediately after purchase, we will obtain any consent and acknowledgement required by law before supplying the content where necessary.
14.3 Digital content supplied to you must be of satisfactory quality, fit for purpose and as described, subject to your statutory rights.
14.4 If you experience a problem with digital content purchased from us, please contact us at info@impgaming.co.uk.
14.5 Where digital codes have been redeemed, we reserve the right to discount any refund by the amount of the value of the software accessed by use of that digital code.
- Product codes, keys and activation
15.1 Where a product includes an activation code, licence key, voucher code or similar digital code, you are responsible for entering the code correctly and complying with the relevant platform or publisher’s terms.
15.2 We will not be responsible for problems caused by entering a code incorrectly where the code itself was valid and correctly supplied, subject always to your statutory rights.
15.3 If a code supplied by us is invalid or does not work as described, please contact us so that we can investigate and provide an appropriate remedy where required.
- Pre-orders
16.1 Where we offer products for pre-order, the estimated release date will be stated on the relevant product page where known and funds will be taken form your chosen payment provider at point of order.
16.2 Release dates supplied by manufacturers, publishers or suppliers may change.
16.3 If a release date changes materially, we will provide updated information where reasonably possible.
16.4 Pre-orders remain subject to your statutory rights, including any applicable cancellation rights.
- Promotions, discounts and promotional codes
17.1 Promotional offers and discount codes may be subject to additional terms displayed alongside the offer.
17.2 Unless expressly stated otherwise, promotional codes cannot be exchanged for cash and cannot be used retrospectively against previous orders.
17.3 We reserve the right to withdraw or amend a promotional offer where reasonably necessary, but this will not affect orders that we have already accepted except where permitted or required by law.
17.4 We will not use promotional terms that unfairly restrict your statutory rights.
- Availability and website errors
18.1 We try to ensure that our website is available and that information displayed on it is accurate.
18.2 We do not guarantee that the website will always be available or free from errors.
18.3 If we discover an obvious error in a product listing, including an obvious pricing error, we may take reasonable steps to correct it.
18.4 Nothing in this section affects any contract that has already been validly formed or any statutory rights you have.
- Our liability to you
19.1 We do not exclude or limit our liability where it would be unlawful to do so.
19.2 In particular, nothing in these terms excludes or limits liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- breach of your statutory rights;
- defective products where liability cannot lawfully be excluded; or
- any other liability which cannot legally be excluded or limited.
19.3 Subject to clause 19.2 and applicable law, we will only be responsible for losses that are a foreseeable result of our breach of these terms.
19.4 We are not responsible for losses that are not reasonably foreseeable or for matters outside our reasonable control, subject to your statutory rights.
- Events outside our reasonable control
20.1 We will not be responsible for delays or failures caused by circumstances outside our reasonable control, including natural disasters, severe weather, industrial disputes, failures of third-party delivery networks, interruptions to utilities or telecommunications, cyber incidents, government action or other similar events.
20.2 If an event outside our reasonable control materially affects our ability to fulfil your order, we will take reasonable steps to minimise the impact and keep you informed where appropriate.
20.3 Your statutory rights, including rights to cancel where applicable, are not affected.
